FDA CBD Regulations: What to Know [2019]

In 2018 at the state level, some jurisdictions have eliminated the prohibition on cannabis and its derived items. On the federal level, the Farm bill (Agriculture Improvement Act of 2018 ) has removed cannabis and its by-products that are very low in THC from the definition of marijuana. As we know, the CBD sale has been legalized, and it enhanced the sales of CBD. The 2018 Farm Bill has changed the entire CBD sales all over the U.S. The U.S. FDA has overall control over the sale of the CBDs.

Lets first understand what the FDA is? FDA stands for Federal Drug Administration. The primary function of the FDA is to regulate and approve drugs and other products that the public will consume. By controlling the drugs, it ensures the quality, safety, and efficiency of the product itself.

But recently, many vendors of CBD across the USA have received the reprimands from the FDA. In the recent blog post of FDA, they stated that their number one priority is safeguarding and promoting the public health of the USA citizens. They also said that its approach towards cannabis and its derived product has been consistent. This step sounds like a significant step for the realm of CBD, but it makes little progress for both small and large businesses.

However, the majority of people are not aware of the rules entirely. And today’s rules can be changed tomorrow. So let us look at the rules to get a clear picture of this Act.

Key Things we know about the FDA CBD rules.

  • We can see the CBD in some of the food and beverage finished goods. That means a finished good CBD item is being included in a food or beverage at the point of sales.
  • As per the FDA guidelines, all the CBD products sold in the USA must fall under 0.3% THC. The terms THC refers to tetrahydrocannabinol; it is a crystalline compound that is the primary active ingredient of cannabis.
  • It also states that all businesses and consumers of CBD must not make any medical claims. It prohibits medical claims such as claiming CBD consumption cures cancer, anxieties, seizures, etc.
  • All the CBD products must disclose the correct information in the advertisements. That means the advertised CBD product must match with the product offered to the consumers.
